Westopolis operates the westopolis.org website (the “website”). Access to and use of the website requires compliance with and agreement to this Privacy Statement and Terms of Use, together called these “Terms of Use.”

Westopolis is committed to operating a website that respects individual privacy. Visitors are not required to provide personal information, and Westopolis does not collect personally identifying information—including a name, email address, Social Security number, or another unique identifier—unless a visitor knowingly provides it.

Westopolis uses that information only to distribute requested travel information, such as e-newsletter subscriptions, destination guides or maps, and to contact sweepstakes and contest winners. Email Newsletter

Westopolis offers a free travel information email newsletter. You may be subscribed because you explicitly requested a newsletter, previously supplied your email address while requesting travel information and indicated that you wanted future travel information, entered a contest or sweepstakes and agreed to receive future travel information, or through other means.

Email newsletter subscriptions require positive confirmation from you by email. Every newsletter includes an option to unsubscribe at the bottom.

Cell Phone Numbers

By providing my wireless phone number to the company, I agree and acknowledge that the company may send text messages to my wireless phone number for any purpose, including marketing purposes. Westopolis will not give or sell your wireless phone number to any third parties.

Westopolis continually improves and expands the website’s features, functionality, and content. Changes to the website or to the law may require these Terms of Use to be updated or revised. Westopolis reserves the right to make modifications at any time without prior notice by posting a revised version of these Terms of Use behind the link marked “Privacy” at the bottom of every website page.

Westopolis links to external sites that assist with its mission – “to promote and facilitate travel to and within the cities of St. Louis Park and Golden Valley.”

Links may lead to individual tourism-related businesses and organizations in St. Louis Park and Golden Valley. Westopolis may also link to external servers with which it is partnered or conducting promotional activities, or to sites offering non-biased information that may help people traveling in Minnesota.

A link to an external server does not constitute official Westopolis endorsement of opinions or ideas expressed there, or a guarantee that the information is valid. Links to commercial sites do not endorse a vendor’s products or services.

External servers are selected when they are managed professionally—for example, when they are fully operational, available most of the time, and do not provide inaccurate information or obscene graphics.

Westopolis will not link to an external server when the link could appear to be an official endorsement of a commercial product or business. Westopolis’ marketing director reviews every link request before approval, and placement of any link remains at the discretion of Westopolis.

General Terms

Security

Anyone using the website should understand that the Internet is inherently insecure and that no website operator can guarantee website security. Westopolis does not warrant that the website is secure or “hackerproof”; you use the website solely at your own risk.

Choice of Law and Forum

The laws of the State of Minnesota, without regard to its conflict of law provisions, govern these Terms of Use and the relationship between you and Westopolis. You and Westopolis agree to the personal and exclusive jurisdiction of the courts located within the county of Hennepin, Minnesota.

Waiver and Severability of Terms

Every waiver must be written and signed in ink on behalf of Westopolis. Westopolis’s failure to exercise or enforce a right or provision of these Terms of Use does not waive that right or provision.

If a court of competent jurisdiction finds any provision invalid, the parties agree that the court should nevertheless endeavor to give effect to the parties’ intentions reflected in that provision. The remaining provisions continue in full force and effect.

Statute of Limitations

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the website or these Terms of Use must be filed within one (1) year after the claim or cause of action arose or be forever barred.

Entire Agreement

These Terms of Use are the entire agreement between you and Westopolis concerning use of the Westopolis Site and supersede prior understandings or agreements between you and Westopolis. This Agreement may be amended or modified only as described above.
